Terms and Conditions 

1. This Terms of Use provides the terms and conditions for the supply of goods through the Ashtar Shining LLP Jewellery website (references to ‘website’ in these Terms shall mean the website www.ashtar.in. This Terms of Use (“Terms”) shall apply to all contracts entered into by Ashtar Shining LLP. By placing your order with us you are accepting these Terms. In the event that these Terms are not accepted in full, you do not have permission to access the contents of this website and should cease using it immediately.
   
2. By visiting/accessing our site and/or purchasing something from us, you engage in our services and agree to be bound by all the terms and conditions mentioned on our website. Please read these Terms carefully before accessing or using our website.
   
3. You mean the person accessing the website (“you” or “Customer”) and these Terms govern your use of our website.
   
4. By accessing or using this website, you confirm that you have read, understood, and agreed to these Terms in their entirety. Ashtar Shining LLP reserves the right to update, modify, or replace these Terms at its sole discretion, without prior notice. Any changes to the Terms will be effective immediately upon posting on the website. Your continued use of the website following the posting of changes constitutes your acceptance of the revised Terms.
   
5. Ashtar Shining LLP reserves the right to modify, suspend, or permanently discontinue any services, features, or content provided on the website at any time, with or without prior notice.
   
6. You agree to use the website only for lawful purposes and in compliance with all applicable laws and regulations. You must not use this website for any unlawful purposes. Ashtar Shining LLP reserves the right to restrict or terminate your access to the website if it determines, in its sole discretion, that you have violated these Terms or engaged in improper use of the website.
7. As a condition of using the Site, the Site requires Your permission to send You administrative and promotional emails. We will send You information regarding Your account activity and purchases, as well as updates about Our products and offers. Please see Our Privacy Policy for details.
   

Contract

1. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act of 1872 are not eligible to use this website. If your age is below 18, you are prohibited to use/purchase/contract from/with, this website. Persons accessing this website from outside India are responsible for compliance with the laws applicable to them.
   
2. No contract will exist between you and Ashtar Shining LLP for the sale of any product unless and until Ashtar Shining LLP has accepted your order with a confirmation email and a full payment is made by you for the product.
   
   

Product Information and Availability

1. Ashtar Shining LLP attempts to be as accurate as possible in the description of the product on the website. All such information is published with due care and diligence; however, Ashtar Shining LLP makes no representation or warranty, express or implied, that such content is accurate, complete, current, reliable, or free from error. Due to the nature of jewellery products, there may be inherent variations in colour, appearance, weight, dimensions or design. These variations are a natural consequence of the production process and shall not be considered to be a defect. By placing an order, you expressly acknowledge and accept the possibility of such variations.
   
2. While every reasonable effort has been made by Ashtar Shining LLP to display the colours, textures, and images of its products on the website with high accuracy, the appearance of such attributes may vary depending on your individual device settings, screen resolutions, lighting, and other technical factors. Ashtar Shining LLP does not warrant or guarantee that the colours or visual representation of the product as displayed on your device will be a precise or complete match with the actual product delivered. By placing an order, you expressly acknowledge and accept the possibility of such variations.
3. Ashtar Shining LLP reserves the right, in its sole discretion, to amend, alter, or update the design, description, specifications, or availability of any product, without prior notice.
   
4. Ashtar Shining LLP provides silver and crystal jewellery products. Prior to purchase, you are solely responsible for verifying the complete product description and material composition, including identifying any substances that may trigger adverse reactions. Ashtar Shining LLP expressly disclaims all liability for any allergic or adverse reactions resulting from product use. You are advised to carefully examine product details and consult with a qualified medical professional before using any product if you have known allergies, sensitivities or concerns.
   
5. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order without providing any reasons in respect thereof to you. We may, in our sole discretion, limit or cancel quantities purchased per person or per order. These restrictions may include orders placed by or under the same customer account, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. In the event of a cancellation of an order by us as stated above, the refund of the payment for the order if already paid shall be processed within 15 business days .
   
6. For orders that are to be shipped internationally (outside India), product availability and our ability to fulfil such orders may vary by region and are subject to applicable export laws, trade restrictions, and customs regulations in both India and jurisdiction where the product is sought to be shipped. We reserve the right to reject or cancel orders that cannot be fulfilled due to such restrictions or where the importation of jewellery is prohibited by law.
   
7. Ashtar Shining LLP reserves the right not to accept your order in the event that we are unable to obtain authorisation for payment, if shipping restrictions apply to a particular item, if the item ordered does not meet our quality control standards and is withdrawn, out of stock or if there is an error in pricing or content. We may also refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable for any indirect or consequential loss, damage or expenses arising from not accepting your order and we shall have no liability to you, by way of compensation, other than to refund the amount paid for the product in question.
   
   

Pricing

1. For products to be offered or sales to be effected within India:
   
   1. Prices listed on the website are in Indian Rupees (INR) and are inclusive of applicable taxes. Prices and availability of products are subject to change without prior notice. Ashtar Shining LLP strives to provide accurate product and pricing information, however errors may occur. We cannot confirm the price of the product until you make the order.
      
   2. Payments can be made by credit cards, debit cards, net banking, UPI , wallets and Cash on Delivery (COD) (for eligible orders). Credit card, debit card, UPI and Net banking payment options are instant payment options which we recommend to ensure faster processing of your order. In cases where payment is made via third-party payment gateways or financial institutions, any fees or charges levied by such entities, including transaction or conversion fees, shall be borne solely by you.
      
   3. The COD payment method shall be available exclusively for domestic orders and only for such order values as may be prescribed by Ashtar Shining LLP from time to time at its sole discretion. Ashtar Shining LLP reserves the right to modify, restrict, or discontinue the availability of the COD option for any product, region, or transaction, for any reason whatsoever, without prior notice.
      
   4. Further, all orders placed through the COD payment method shall be subject to a non-refundable insurance and risk coverage fee ranging from Rs. 300 to Rs. 400 or such other amount as may be determined by Ashtar Shining LLP at its sole discretion.
      
2. For products to be offered or sales to be effected internationally (outside India):
   
   1. Prices listed on the website will be (a) denominated in international currencies such as US Dollar or Euro as decided by Ashtar Shining LLP from time to time. In case of INR prices listed on the website, Ashtar Shining LLP may confirm the applicable US Dollar / Euro prices to you by contacting you on the e-mail and/or billing address/phone number provided at the time the order was made. Billing will be done subject to applicable laws and by permissible remittance methods supported by our payment gateway and on such terms that our payment gateway may provide for. We do not accept Crypto payments and Cash on Delivery (COD)for international orders.
      
   2. For international orders additional charges may be applicable on account of (a) additional packaging, (b) clearing, forwarding, handling and courier/freight, (c) any export declarations or certifications, or (d) any other requirements. All prices listed on our website are exclusive of applicable taxes, duties, tariffs, customs fees, or other related charges. Shipping and handling charges are additional and are calculated at checkout or invoiced separately, depending on the destination and delivery method.
      
   3. All international orders are shipped on delivered-at-place basis.  You acknowledge and agree that all import duties, taxes, fees, brokerage and any other charges levied by the importing country's customs authorities, port authorities, or any other government or other agency are your sole responsibility. Ashtar Shining LLP shall not be held liable for any such charges, fees, or assessments. You are advised to research and understand the import regulations and associated costs of their respective country prior to placing an order. 
      
   4. In the event that you refuse or fail to take delivery of a shipment dispatched by Ashtar Shining LLP to an international destination for any reason, including but not limited to, refusal to pay applicable customs duties, taxes, import fees, clearance charges, or other related expenses levied by the importing country's authorities, you shall be liable for all costs incurred by Ashtar Shining LLP as a result of such refusal or failure. These costs may include, but are not limited to: (a) return shipping fees, (b) storage fees, (c) customs clearance fees for the return shipment, (d) any other administrative or handling charges incurred by Ashtar Shining LLP, and (e) any loss in value of the goods due to damage or deterioration during the return process.
      
   5. Ashtar Shining LLP reserves the right to deduct these costs from any refund due to you or to invoice you for these costs separately. Furthermore, Ashtar Shining LLP reserves the right to withhold any future shipments to you until all outstanding charges are settled. By placing an order with Ashtar Shining LLP for international shipment, you acknowledge and agree to this clause and accept full responsibility for all associated costs that may arise therefrom.
3. Prices and availability of products are subject to change without prior notice. Ashtar Shining LLP strives to provide accurate product and pricing information, however errors may occur. We cannot confirm the price of the product until you make the order
   
4. Ashtar Shining LLP reserves the right to modify the prices of products listed on the website at its sole discretion and without prior notice. In the event of any typographical error, technical malfunction, or other discrepancies in the pricing information displayed on the website, Ashtar Shining LLP reserves the right to rectify such errors.
   
5. From time to time, Ashtar Shining LLP may offer promotional pricing, discounts, or special offers. Such promotions are subject to specific terms and conditions, including validity periods, which shall be communicated at the time of the promotion. Ashtar Shining LLP reserves the right to withdraw or modify such promotions without prior notice. 
   
   

Gift Card

1. We may in our sole discretion choose to issue gift cards. Such gift cards are available in denominations of Rs. 5000, Rs. 15000 and Rs. 25000 or any other denomination as may be decided by us (or equivalent value thereof in other supported currencies as may be decided by us in our sole discretion).
2. All gift cards are digital in nature and issued electronically. They are valid for a period of 365 days commencing from the date of issuance, unless otherwise revoked in accordance with these Terms.
3. We reserve the right to reject any gift card if: (a) we suspect that the gift card has been already utilized, (b)  if the gift card is invalid, expired, tampered with or (c) we determine, in our sole discretion, that such action is necessary to prevent abuse or protect our interests, systems, or customers.
4. Gift cards are non-transferable and cannot, in part or in whole, be (a) redeemed for cash/gift cards/credit notes (b) refunded; or (c) substituted, under any circumstances. Gift cards must be exclusively and solely applied/redeemed towards purchases made on the website.
5. In cases where the invoice amount for a purchase on the website exceeds the gift card value, you shall be solely responsible for paying the difference through other accepted payment methods. 
6. We are not and shall not be held liable for any unauthorized and/or fraudulent purchases made using a gift card.
7. We will presume, without obligation to verify, that the person redeeming the gift card is the lawful and intended recipient/beneficiary of the gift card. We are not and shall not be held liable for any misuse arising from incorrect or unauthorized redemption.
8. The Company's sole obligation with respect to electronic gift cards is limited to their issuance. Under no circumstances shall the Company incur any liability for any financial payment whatsoever for any issue arising from or related to electronic gift cards that is not expressly covered by these Terms of Use.
9. These gift card terms are a part of, and must be read in conjunction with, these Terms which govern the use of the Website.
10. The resale, duplication, or commercial exploitation of gift cards in any form is strictly prohibited and shall render any such gift card void.
11. Gift Cards may be used as personal or business gifts but cannot be used in connection with any marketing, advertising or other promotional activities (including without limitation via websites, internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, and radio and television broadcasts) without our prior written consent.
12. By purchasing or using a gift card, you represent and warrant that the gift card will not be used in any way that is unlawful, misleading, deceptive, harmful, or otherwise in violation of these Terms or applicable laws.
13. You agree to fully indemnify, defend, and hold harmless Ashtar Shining LLP, its affiliates, officers, directors, employees, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising out of or related to your purchase, distribution, or use of the gift card, or your breach of any representation or obligation under these Terms.
14. These Gift Card Terms are applicable to both domestic and international purchases.
    

Intellectual Property

1. All content, designs, and trademarks on the website, including but not limited to the jewellery designs, photographs, logos, and content, are protected by copyright, trademark, and other intellectual property laws or licensed for use by Ashtar Shining LLP. Any unauthorized use is prohibited. Nothing contained on the website should be construed as granting, by implication or otherwise, any licence or right to use any trademark or other intellectual property owned by Ashtar Shining LLP without Ashtar Shining LLP’s prior written permission or that of such third party who owns the trademark or such other intellectual property. Misuse of any trademark displayed on the website, or any other content on the website is strictly prohibited.
   
2. Ashtar Shining LLP grants you a limited, non-exclusive, non-transferable, revocable license to access and use the website for personal, non-commercial purposes, in accordance with the terms set forth herein. This license does not permit you to modify, reproduce, display, or distribute any content from the website, except as expressly authorized by Ashtar Shining LLP in writing.
   
3. You acknowledge and agree that the products displayed on the website are the artistic creations of Ashtar Shining LLP. All intellectual property, including but not limited to copyrights, relating to products on the website is owned by Ashtar Shining LLP. You further acknowledge that the purchase of any product does not convey, transfer, or assign any intellectual property rights to you, and that such rights remain vested with Ashtar Shining LLP at all times. You are expressly prohibited from copying, reproducing, modifying, creating derivative works of, distributing, displaying, or otherwise exploiting any content or intellectual property from the website, including but not limited to the creation or distribution of any physical replicas, reproductions, 3D models or other virtual representations of Ashtar Shining LLP’s jewellery designs or any other content on the website,  without the prior written consent of Ashtar Shining LLP. Any unauthorized use of the website’s intellectual property is considered a violation of Ashtar Shining LLP’s rights and may result in legal action.
   
   

Shipping Policy

1. For domestic orders to be delivered within India, Ashtar Shining LLP offers complimentary standard shipping on orders exceeding such minimum order value as may be prescribed by it from time to time, which shall be determined and calculated at the time of checkout. For orders that do not meet the prescribed minimum value, shipping charges shall apply. Such charges shall be calculated based on including but not limited to the total order value and delivery location and shall be communicated to you during the checkout process. 
2. We currently offer international shipping to selected countries using authorized logistics partners. Shipping timelines, delivery estimates, and costs are provided at checkout and may vary depending on destination, weight, product value, and shipping method selected. Ashtar Shining LLP is not and shall not be held liable for any delays caused by customs authorities, port congestion, regulatory requirements, inspections, or any other reason beyond its control.
   
3.  Delivery times may vary based on the shipping method chosen and the delivery address. The delivery timelines are as follows
   

   1. Typically, for orders shipped using standard shipping, the estimated delivery time for domestic shipments within India  is between 10-15 business days from the date the order is dispatched.

   2. Typically, for orders shipped using standard shipping, the estimated delivery time for international orders will take 15-22 business days from the date the order is dispatched.

4. Orders will be processed and dispatched within 5  business days of order confirmation, subject to product availability. You will receive a shipping confirmation email containing tracking information once the order has been dispatched. You can track the status of their shipment via the provided tracking number.
   
5. While we make every effort to ensure timely delivery, Ashtar Shining LLP shall not be liable for any delays caused by third-party courier/delivery services, force majeure events, or circumstances beyond our control, including but not limited to weather disruptions, strikes, or other unforeseen events.
   
6. For international orders, all items included in a single purchase transaction shall, to the extent practicable, be consolidated and dispatched in a single shipment. Partial dispatch or split shipments shall be made solely at the discretion of Ashtar Shining LLP.
7. It is your responsibility to provide accurate and complete shipping information at the time of purchase. Ashtar Shining LLP shall not be liable for any delays, losses, or issues arising from incorrect or incomplete delivery details provided by you.
   
8. All products are securely packaged to ensure safe delivery. Ashtar Shining LLP is not liable for damage to the product caused by mishandling or improper care during transit once it has been shipped.
   
   

Refund and Return Policy

1. Return and/or exchange requests shall be permitted strictly on a one-time basis per order, regardless of the number of items purchased under such order. Subsequent requests for return or exchange in respect of the same order shall not be entertained under any circumstances.
   
2. Ashtar Shining LLP does not accept returns of products except in cases of defective/damaged products and only after you have fully complied with these Terms. Ashtar Shining LLP does not offer any returns or exchanges for size related discrepancies.
   
3. No refund, replacement, or re-delivery shall be issued for international orders under the following circumstances: (a) Where an incorrect, incomplete, or outdated delivery address is provided by the customer; (b) Where delivery fails due to the unavailability of the recipient, refusal to accept the package, or failure to comply with applicable import or delivery requirements; or (c) any other circumstance as may be determined by Ashtar Shining LLP, in its sole discretion. In all such cases, the risk of loss, non-delivery, or return shall rest solely with you, and any associated costs shall be borne exclusively by you. Ashtar Shining LLP shall not be liable for any such loss
   
4. A non-refundable processing fee of Rs. 500 shall be applicable to all approved return requests. Ashtar Shining LLP does not issue cash refunds for returned products. Upon successful processing of a return of a product, you may be entitled to receive store credit after deducting the processing fee of Rs. 500, which may be redeemed for future purchases on the Website.
   
5. Any store credit issued by Ashtar Shining LLP shall be valid strictly for a period of fourteen (14) calendar days from the date of issuance. You shall be solely responsible for tracking the validity period and applying such credit within the designated time frame. Upon expiry, any unutilized credit shall automatically lapse without further notice, and Ashtar Shining LLP shall have no obligation to reinstate, extend, or refund such credit under any circumstances.
   
6. Store credit may be applied only towards the listing price of eligible products available for sale through our website. Store credit shall not be applicable towards payment of shipping or delivery charges, customs duties, taxes, insurance, handling fees, or any other ancillary costs associated with the order. All such charges shall remain your sole responsibility. Store credit is non-transferable, non-exchangeable for cash or any monetary equivalent, and may not be combined with other offers unless explicitly allowed.
7. All requests for returns and exchanges shall be initiated solely via Ashtar Shining LLP’s WhatsApp interface/website or any other interface designated for this purpose by Ashtar Shining LLP.
   
8. Ashtar Shining LLP may, at its sole discretion, offer certain products that are eligible for customization. All such customized or made-to-order jewellery items are expressly excluded from the return, refund, or exchange policy.
   
9. Accordingly, customized products shall not, under any circumstances, be eligible for return, replacement, or refund. You acknowledge and agree that by placing an order for a customized product, you waive any right to cancellation, return, or exchange of such product.
   
   

Defective and damaged products

1. All parcels must immediately be opened in the presence of the courier upon receipt of the product/s, to verify that the product/s contained in the parcel are untampered with, undamaged and not defective. 
2. If your purchase meets the return eligibility criteria as stated in these Terms, you are required to initiate the return process by contacting our customer care team strictly within forty-eight (48) hours of receipt of the product. The following information must be provided at the time of making such a request: (a) Order number; (b) Complete delivery address; and (c) A clear description of the reason for return. In cases involving a defective, damaged, or incorrect product, photographic evidence must be provided.
3. Failure to adhere to this process and timeline shall result in the forfeiture of any right to return or exchange the product and Ashtar Shining LLP shall not be liable for the same.
   
4. Upon receipt of a valid return request, our internal Quality Check team shall inspect the product for claimed manufacturing defects or non-conformities. Based on the outcome of the verification, our customer service team will contact you with further instructions regarding the return process.
5. The product must be received within 10 days from the date of advice by the Customer Service Department. Products must be returned in their original, unused, and unworn condition, with all original tags, certificates, packaging, and accompanying documentation intact. Ashtar Shining LLP reserves the right to reject any return that fails to meet these conditions, and no refund or exchange shall be issued in such cases.
6. Our Quality Check team will verify the manufacturing defects, after that our customer service team will email or contact you for the necessary action.  
7. You agree and acknowledge that if you fail to do this and subsequently find any defects whatsoever with the product/s, you will be solely liable for any such loss or damage and shall not be entitled to a refund or a replacement of the product. For the avoidance of doubt, any tarnishing or discoloration of the product(s) shall not be considered a defect or damage as stated herein. Notwithstanding what is stated in these Terms of Use, on acceptance of the order all your claims, if any, shall be waived, released and shall stand extinguished.
   
8. In the event that you receive a product that is defective or damaged, please contact our customer service team as per the details provided in the ‘contact us’ section on the website immediately upon receipt of the product.
   
9. Returns require the product to be unused, with all original tags attached and intact on the product. For any defects/damage upon receipt, a video recorded immediately, showing packaging, condition, and any issues, must be emailed to Ashtar Shining LLP. Returns of used, damaged products (without initial receipt video for damage claims) or those with missing original tags will be declined, and no refund shall be issued. Ashtar Shining LLP assumes no liability for non-compliant returns.
   
10. After evaluating the defects/damage, if there are any, Ashtar Shining LLP may appropriately offer either store credit or replacement of the product if the situation so warrants, on such terms as it may deem fit. Replacement of the product is available only for orders that were shipped domestically within India. For international orders (i.e., shipped to destinations outside India) we are unable to offer replacement and can only offer store credit, provided you have complied with these Terms. Failure to comply with the requirements stipulated herein may render the return or exchange request ineligible for processing, at the sole discretion of Ashtar Shining LLP.
    
    

Cancellation and modification

1. Orders may only be cancelled within a period of twenty-four (24) hours from the time the order was placed. No cancellation requests shall be entertained beyond this period.
   
2. For orders cancelled within twenty-four (24) hours from the time of placement of the order, you, subject to compliance with these Terms, may be eligible for a refund or a store credit equivalent to the product value (less any payment gateway transaction fees or processing charges or other charges of similar nature), as may be determined by Ashtar Shining LLP in its sole discretion. In cases of refund, the same shall ordinarily be processed to the original mode of payment used at the time of placing the order. This store credit or refund shall be issued to you within a period of 15-20 business days from the date on which the request was raised. In cases where refund processing through the original payment channel is delayed or rendered infeasible due to reasons beyond Ashtar Shining LLP’s control, we reserve the right to contact you for alternate payment instructions. Any refund timeline shall be subject to the processing timelines of the respective banks or payment service providers, and Ashtar Shining LLP shall not be liable for delays beyond its reasonable control.
   
3. Orders may be modified prior to dispatch thereof. Once the order has been dispatched, no modification requests shall be permitted.
   
4. Any approved modifications made prior to the dispatch of the order shall be refunded in the form of store credit.
   
   

Marketing communications

1. By creating an account, making a purchase, or otherwise providing your contact information on the Website, you expressly consent to receive marketing communications from Ashtar Shining LLP. These communications may include, but are not limited to:
   
   1. Updates about new product launches and collections.
   2. Exclusive promotional offers, discounts, and sales events.
   3. Information about upcoming events, collaborations, or company news.
   4. Such communications may be delivered via email, SMS, phone calls, or other channels as provided by you during registration or checkout.
      
2. You may opt out of receiving marketing communications at any time. This can be done by clicking the “unsubscribe” link provided in marketing emails.
   
3. Ashtar Shining LLP may use your personal information to provide tailored marketing content and personalized offers. By using this website, you also consent to this use of your data.
   
4. Ashtar Shining LLP does not sell or share your personal information with third parties for their direct marketing purposes without your consent.
   
   

Your Obligations

1. In using the website and availing our services, you expressly undertake to do the following –
   
   1. You shall provide true, accurate, current, and complete information about yourself, including valid address, mobile number, and email address, at the time of registration or placing the order, as the case may be.
      
   2. You shall promptly update any information provided to us and ensure it remains true, accurate, current, and complete. Ashtar Shining LLP reserves the right to verify and validate the information and other details submitted by you at any time. Additionally, Ashtar Shining LLP retains the right to request additional information prior to accepting orders or processing deliveries in certain circumstances. If, upon verification, it is determined that your details are false, incomplete, inaccurate, outdated, or otherwise not in accordance with these Terms, or if Ashtar Shining LLP has reasonable grounds to suspect any of the provided information is incorrect, we reserve the right to suspend or terminate your use or access of our website indefinitely, without prior notice.
   3. You confirm that the delivery address provided for the product(s) ordered is accurate, complete, and correct in all respects. In the event of non-delivery due to an error on your part (such as incorrect name, address, or any other incorrect information), you shall bear any additional costs incurred by Ashtar Shining LLP for re-delivery, which shall be payable by you.
      
   4. Before placing an order, you are required to carefully review the product description. By placing an order, you acknowledge that you are fully satisfied with the details of the product, including its features, specifications, and characteristics.
